Privacy & Data Protection Policy

Océole (the "Océole Project") is a partnership between Q ENERGY France, EQUINOR and Green Giraffe.

Q ENERGY France is committed to respecting each individual's right to privacy and to comply with applicable laws. The purpose of this policy (the "Privacy Policy") is to inform you about the personal data collected from you in the context of this website dedicated to the Océole Project accessible at www.oceole. fr (the "Website") and more generally about the conduct of the Océole Project, about the way in which this Personal Data may be used and communicated, about the way in which your personal data is protected, as well as about the rights you have in this respect, in compliance with the provisions of the French law n°78-17 of January 6, 1978 relating to data processing, files and freedoms (hereinafter "LIL"), and the European Union Regulation 2016/679 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (hereinafter "RGPD").

Who is responsible for the processing of your Personal Data? :

  • The data controller for the Océole Project is Q ENERGY France, a simplified joint stock company with a share capital of 8,791,792.00 euros, whose registered office is located at ZI de Courtine, 330 rue du Mourelet, 84000 Avignon, registered in the Avignon Trade and Companies Register under number 423 379 338.
  • Within the framework of the Océole Project, QENERGY France may transfer some of the data collected to two partner entities, Equinor and Green Giraffe, which act respectively as independent data controller for the uses they make (for more information, see the data sharing section).

What personal data do we collect?

We collect identity data, which may include contact information such as your name, e-mail address, telephone number or postal address when you fill out an online form on our Website.

If you contact us by email or other means and provide information about yourself, this personal information will also be collected and used for the purpose of responding to your enquiry or processing your request.

We do not collect sensitive personal data: we ask you not to disclose or communicate to us any data considered as sensitive data or assimilated as such by the CNIL (notably social security number, offence data, ethnic origin, political opinions, religions and beliefs, health data or trade union affiliation) through our Website.

In the context of the Océole Project, we may also collect and process personal data about you that is publicly available or that you volunteer. This data may include identification data, contact information, business data, or your opinions and comments about the Océole Project.

Services may be associated with websites operated by third-party companies not affiliated with Q ENERGY, and may include advertising, online content, and features, games, newsletters, contests or sweepstakes, or applications developed by third-party companies. Q ENERGY is not responsible for the privacy practices of such third-party companies. Once you leave the Website or click on an advertisement, it is your responsibility to check the privacy policy applicable to that other service.

Why and on what basis do we collect personal data about you?

In the context of the Océole Project, your Personal Data are collected and processed by Q ENERGY France, as the data controller, in order to:

  • Provide pre-contractual information or information related to the Océole Project that you may request from Q ENERGY France;
  • Provide the services you wish to receive and manage our business relationship;
  • To satisfy the legitimate interests of Q ENERGY France, such as managing business with its prospects, customers or partners, ensuring the proper conduct of the Océole Project and relations with local stakeholders or third parties concerned, conducting information campaigns about the Océole Project or conducting satisfaction or opinion surveys about it. In the development and construction of floating wind projects, it is necessary for us to consult with and keep local stakeholders informed. To this end, we may also have a legitimate interest in conducting mail and other media campaigns;
  • To comply with the law, regulations, and legal requests and orders applicable to Q ENERGY France.

In some cases, processing by Q ENERGY France and its partners in the context of the Océole Project may be based on your consent. In this case, you will be provided with specific information at the time your personal data is collected and consent is obtained.

Q ENERGY France may collect and use information about you for use in the Océole partnership between Q ENERGY France, Equinor and Green Giraffe for the development of offshore wind projects. Your personal information may also be collected and used to improve the services we provide to you or to respond to enquiries or other issues you raise.

Q ENERGY France may also use information submitted by you or otherwise obtained by us to conduct marketing research, but we do not sell personal information or disclose it to third parties for purposes unrelated to the reasons we hold it.

Will we share your personal data with other organisations?

As part of the Océole partnership, Q ENERGY France may share your data with members of EQUINOR (a Norwegian company) when this is necessary for the strict purposes of the Océole project and/or the processing of your request. In this case, personal data is communicated only for the purpose for which it was collected, in accordance with this Privacy Policy. EQUINOR, as an independent data controller, undertakes to comply with the regulations relating to personal data, namely the LIL and the RGPD.

We will not pass on the data you provide to us to organisations outside the Océole partnership. However, Q ENERGY France may be required to disclose it to the relevant authorities if required by law, including for legal compliance purposes. We may also share your personal data with our outside contractors, suppliers or advisors solely for the purposes of the Océole Project and/or to provide our services: for example, to engage outside advisors to assist us with a matter involving you or your organization (including any litigation or M&A transaction involving our company, for example), or with our IT contractors.

Where the performance of our business requires your personal data to be transferred outside the European Union, it is understood that such transfers are governed by the mechanisms set out in the GDPR and validated by the European Commission, such as the Standard Contractual Clauses, a copy of which you may request (see "Contact Us" below).

For how long and in what way is your personal data stored?

Your personal data is stored in accordance with our internal storage policies which are designed to ensure the proportionality and minimisation of our processing of personal data, as well as the security and confidentiality of the data.

We will retain your personal data for as long as is reasonably necessary for the purpose for which it was collected or is further processed including for legal and internal compliance purposes and for the potential defence of claims in the future, or if we are otherwise permitted to do so.

If you request that we no longer process your personal data, we will do so to the extent possible, subject to any applicable legal restrictions and our information retention requirements in order to fulfil our legal and internal compliance obligations, including demonstrating compliance in the future should legal proceedings be brought against us.

How can you find out what information is stored about you? What are your rights?

You have the right to access, rectify and update the personal data we process about you, provided you complete a request and, if necessary, provide proof of your identity. In the cases provided for by the applicable regulations, you also have the right to have your data deleted, to object to their processing or to request their limitation or portability.

You are always free to ask us to stop contacting you. If you receive an unsolicited communication from us and do not wish to receive further communications.

We undertake to deal with your request to exercise your rights as soon as possible in accordance with the relevant legislation. In all cases, we will do our utmost to ensure that the personal data we hold is accurate, up to date and relevant and we undertake to correct any inaccuracies.

You also have a right of recourse to a national supervisory authority, such as the Commission Nationale de l'Informatique et des Libertés in France.
